This weekend, we pause to honor the men and women who gave their lives in service to our country. Their courage, their sacrifice, and the families who carry their memory forward are the reason we have the freedoms, and the rights, we work to defend every day.

WAGE & HOUR

Overtime exemption thresholds remain in flux.

Following ongoing federal litigation over the FLSA salary-basis thresholds, many salaried employees previously reclassified as exempt may again be entitled to overtime. Employers should re-audit classifications; employees who logged unpaid hours should review their pay stubs from the last two years.

WORKPLACE RIGHTS

Florida heat-illness protections under renewed scrutiny.

Outdoor and warehouse workers retain federal OSHA protections requiring water, shade, and rest in extreme heat, regardless of state-level preemption efforts. Retaliation for raising safety concerns remains unlawful, and complaints are time-sensitive.

RECENT RULINGS

Non-compete enforceability continues to narrow.

Courts in Florida and across the Eleventh Circuit have continued to scrutinize the geographic scope and legitimate business interest behind restrictive covenants. If you are weighing a job change, or asked an employee to sign one, the agreement on the table may be more negotiable than it looks.
